This privacy policy forms part of the Terms and Conditions.

SHK Asia Pacific, ABN 25 126 783 588 and its related companies are committed to ensuring the responsible handling of the personal information of our candidates, contractors, clients, users of the SHK web site and services in accordance with the Commonwealth Privacy Act 1988 and the Privacy Amendment (Notifiable Data Breaches) Act 2017 (APPs).

A Privacy Officer has been appointed to ensure personal information is managed in accordance with this policy, the Privacy Act and the Privacy Amendment (Notifiable Data Breaches) Act 2017 (APPs). This privacy policy may be amended, revised or replaced from time to time.

Personal information

Personal information is any information that can personally identify you. By providing your personal information and/or engaging with SHK, you agree to (we or us or SHK) using your personal information as set out in this privacy policy and disclosure of that personal information to provide you with services offered from time to time through our websites or by us or our affiliates.

You agree to us disclosing your personal information if we have reason to believe that this is necessary to identify, contact or bring legal action against anyone damaging, injuring or interfering (intentionally or unintentionally) with our rights, property, users or anyone else who could be harmed by such activities. Collection

SHK will only collect information that is reasonably necessary for the purposes of providing our services. Personal information may be collected from referees, previous employers, professional registration authorities and educational institutions, which may be in a position to provide us with information that we may use to assess the suitability of candidates to be placed in or continue in positions offered.

The primary purpose for us collecting information is to allow for:

  • Sales contact

  • Permission based marketing

  • Distribution of newsletters

  • Distribution of job alerts to job seekers, and development of resume and profile talent pools that are marketable to prospective employers

  • Processing of your online transactions.

Site users giving any personal information voluntarily via our website will be understood by us as giving consent to this information being viewed by us and our clients. Such information may be saved by us and the user may be contacted as a result.

We do not collect or use personal information for the purposes of unlawful discrimination. We do not collect personal information if we have no present need for it and only conduct criminal history checks to obtain relevant criminal history with regard to particular jobs you are offered or for which you are shortlisted.

Security

We ensure that the personal information of users is secured and protected. Users' personal information is stored in a database, protected by password, and accessible only to the user themselves and those employees who require access to perform necessary responsibilities relating to the management of users' accounts.

Our internal servers are also protected by firewalls that are continuously monitored. Employees are also made aware of the importance of security and confidentiality through SHK policies. Our external databases are covered by strict international storage and privacy guidelines with many layers of firewall defence.

Cookies

We use session cookies to identify you as a current user and these are alive only for the duration of your browser session. If you disable or reject session cookies, you may not be able to access and use all features of our sites. You may adjust your browser settings to disable cookies being stored on your hard drive; however this may impact your user experience.

When visiting our website, the site server makes a record of the visit and logs the following information for statistical and administrative purposes:

Individuals may contact SHK’s Privacy Officer (details below) to update personal information. Users are encouraged to notify us of any amendments to their information in order for us to maintain accurate and up to date information.

Users at any stage can opt out of receiving newsletters or marketing information.

Should you have any difficulty opting out of any of our databases, please contact us, and a staff member will personally assist you. You can request that we remove your personal information by contacting us, in which case we will disable your account.

E-commerce

All credit card data and information (other than the receipt number) are not retained after the transaction has been processed and cleared. All e-commerce transactions are carried out in real time using an automatic payment gateway and are conducted securely via our payment gateway provider.

  • To build business relationships with candidates, contractors, clients or users of this website

  • To assist in work performance or work rehabilitation

  • To keep you informed of our services or to provide industry news, survey results or invitations to attend events (including provision for you to unsubscribe to these types of communication)

  • To understand how best to update our website with information that candidates, contractors, clients and users of the website will find useful

  • To conduct labour market research by aggregating the personal information so that it becomes non-identifiable.

SHK will hold your personal information in our Bullhorn database, which is hosted on the Bullhorn.com platform unless you request it to be removed and will then be de-identified or destroyed provided it is lawful for us to do so. Paper-based records are disposed of via secure document destruction facilities. Employees are also made aware of the importance of security and confidentiality through SHK policies.

We endeavour to keep personal information current and accurate. We recognise that people's situations may change frequently. We will update address and contact details upon your telephone contact. If we have disclosed personal information about you that is inaccurate, out of date, incomplete, irrelevant or misleading, you can ask us to notify the third parties to whom we made the disclosure and we will take such steps (if any) as are reasonable in the circumstances to give that notification unless it is impracticable or unlawful to do so.

SHK will not disclose your personal information unless you have provided your express permission. We take reasonable steps to protect the personal information we hold from unauthorised access, disclosure, modification, misuse or loss.

SHK will sometimes collect information that you choose to provide us via online forms, email etc. It is important that you understand that there are risks associated with use of the internet and you should take all appropriate steps to protect your personal information. You have a right to complain about our handling of your personal information if you believe that we have interfered with your privacy.
